Welcome to BIDXUP.com ("BIDXUP", "we", "us", or "our"). These Terms of Use ("Terms") govern your access to and use of the BIDXUP website, platform, public leaderboards, listing services, payment facilities, and related features (collectively, the "Service").

By accessing BIDXUP, creating a listing, submitting a URL or social media handle, purchasing a ranking, or otherwise using the Service, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use BIDXUP or purchase any ranking.

1. About BIDXUP

BIDXUP is a digital ranking and leaderboard platform where users may submit eligible URLs, social media handles, profiles, products, projects, or other permitted listings and obtain a position on a public leaderboard by making a payment according to the applicable ranking rules displayed on the website.

BIDXUP does not guarantee that any listing will generate traffic, followers, sales, customers, engagement, investment, publicity, or any other commercial or personal benefit.

A higher position on BIDXUP does not constitute an endorsement, recommendation, verification, or certification of the listing by BIDXUP.

2. Eligibility

To use paid features of BIDXUP, you must have the legal capacity to enter into a valid and binding agreement under applicable Indian law.

If you are using BIDXUP on behalf of a business, organization, or another person, you represent that you have the authority to accept these Terms on their behalf.

You are responsible for ensuring that your use of BIDXUP complies with all laws and regulations applicable to you.

3. Creating a Listing

When creating a listing, you may be required to provide information such as:

• Your name or display name
• Email address
• URL or social media handle
• Listing category
• Ranking amount
• Other information required to operate the Service

You agree that the information you submit must be accurate, lawful, and not misleading.

Prohibited Content

Users must not submit, rank, promote, advertise, or display content through BIDXUP that is:

• illegal or unlawful;
• obscene or sexually explicit;
• pornographic or sexually exploitative;
• exploitative or abusive;
• fraudulent or deceptive;
• defamatory or intentionally misleading;
• hateful or discriminatory in violation of applicable law;
• threatening or encouraging violence;
• related to terrorism or other unlawful activities;
• related to illegal drugs, illegal services, or other unlawful activities;
• intended to facilitate fraud, scams, phishing, or other deceptive practices;
• infringing another person's intellectual property or other legal rights;
• violating another person's privacy;
• containing malware, viruses, malicious code, or other harmful material;
• impersonating another person, business, organization, or authority; or
• otherwise prohibited under applicable Indian law.

BIDXUP reserves the right to reject, remove, suspend, restrict, or permanently disable any listing that violates these Terms or applicable law.

4. Public Leaderboard

By submitting a listing for ranking, you understand that certain information may be publicly displayed on BIDXUP, including display name, listing title, submitted URL or handle, category, ranking position, ranking amount, listing date, and other leaderboard information.

You should not submit personal information that you do not want to be publicly displayed.

5. Ranking System

BIDXUP may operate one or more leaderboards, including daily, all-time, category-based, or other types of rankings.

The applicable ranking rules, minimum amount, increment amount, maximum amount, ranking period, and other rules will be displayed on the relevant BIDXUP page.

Unless otherwise stated on the website, purchasing a ranking does not permanently guarantee a particular position. When another eligible listing obtains a higher ranking amount, your listing may move down the leaderboard.

BIDXUP may change, pause, or discontinue any leaderboard or ranking system where reasonably necessary for operational, legal, security, or business reasons.

6. Payments

Paid features of BIDXUP may require payment before the Service is activated. Payments may be processed through third-party payment service providers or payment gateways made available by BIDXUP.

BIDXUP does not store complete payment card details where those details are handled directly by the payment provider.

7. Taxes and Charges

Applicable taxes, including Goods and Services Tax (GST), may be charged where required by applicable law. The final amount payable will be displayed before payment where applicable.

8. Refunds and Cancellation

Because ranking is a digital service that may be activated or publicly displayed after payment, payments will generally be non-refundable once the ranking service has been successfully processed or activated, except where BIDXUP expressly permits a refund, a payment was accidentally made more than once, the payment failed but the amount was actually deducted, a refund is required under applicable law, or BIDXUP determines that a refund is appropriate.

If an amount has been deducted from your account but your ranking was not successfully created due to a technical issue, you may contact BIDXUP with the relevant transaction details.

Nothing in this section is intended to exclude any mandatory consumer right or legal remedy available under applicable Indian law.

9. Prohibited Use

You must not use BIDXUP to commit or facilitate fraud, misrepresent your identity, manipulate payment systems, submit illegal or prohibited content, infringe rights, interfere with security, gain unauthorized access, scrape data without permission, upload malware, manipulate rankings through fraudulent transactions or bots, engage in money laundering, impersonate others, or otherwise use BIDXUP for unlawful purposes.

BIDXUP may suspend, remove, restrict, or terminate users or listings involved in prohibited activities.

10. Intellectual Property

The BIDXUP website, including its brand, logo, design, user interface, layout, text, graphics, images, animations, software, source code, features, functionality, database structure, and other original website materials, are owned by BIDXUP or its respective rights holders and may be protected under applicable Indian intellectual property laws.

10.1 Anti-Copying and Unauthorized Use

Without prior written permission from BIDXUP, no person may copy, reproduce, publish, republish, extract, modify, reverse engineer, or reuse BIDXUP's protected content, branding, source code, original artwork, text, graphics, design expression, or other proprietary materials, except where expressly permitted by applicable law.

10.2 Independently Developed Similar Services

Nothing in these Terms is intended to prevent any person from independently developing a similar business idea, general functionality, or service where permitted by applicable law. Such development must not involve unauthorized copying of BIDXUP's protected content, branding, source code, original artwork, text, graphics, design expression, or other protected materials.

10.3 Reservation of Rights

BIDXUP reserves all rights that are not expressly granted under these Terms.

11. User-Submitted Content

You retain ownership of content that you lawfully submit to BIDXUP. By submitting content, you grant BIDXUP a limited, non-exclusive, royalty-free license to host, store, reproduce, display, format, and technically process that content to the extent reasonably necessary to operate, maintain, promote, or improve the Service.

12. Third-Party Websites and Services

BIDXUP may contain links to third-party websites, platforms, social media services, payment providers, or other external services. BIDXUP does not control these third-party services and is not responsible for their content, availability, policies, security, or practices.

13. Service Availability

We aim to keep BIDXUP reliable and available, but we do not guarantee continuous or error-free operation. The Service may temporarily become unavailable due to maintenance, system upgrades, technical problems, hosting or infrastructure issues, payment provider issues, security incidents, circumstances beyond our reasonable control, or legal requirements.

14. Listing Accuracy

BIDXUP is a platform where users can submit listings themselves. Unless expressly stated otherwise, BIDXUP does not independently verify every claim, product, service, URL, profile, business, or statement submitted by users. The appearance of a listing does not mean BIDXUP has verified or endorsed it.

15. Content Review and Removal

BIDXUP may review, restrict, remove, disable, or reject a listing if it reasonably believes the listing violates these Terms, applicable law, another person's rights, creates a security or legal risk, contains fraudulent information, or may affect the integrity of the Service.

16. Privacy and Personal Data

BIDXUP may collect and process personal data necessary to provide the Service, process payments, prevent fraud, maintain security, communicate with users, and comply with applicable law. Details are provided in the BIDXUP Privacy Policy.

17. Communications

By using BIDXUP or providing contact information, you may receive necessary communications relating to your listing, payment, account, security, or use of the Service. Marketing communications will be handled in accordance with applicable law and available preferences.

18. Suspension and Termination

BIDXUP may suspend or terminate access or remove a listing if you materially violate these Terms, create a security or legal risk, fraud or abuse is suspected, termination is required by law, or the relevant Service is discontinued.

19. Disclaimer

To the maximum extent permitted by applicable law, BIDXUP provides the Service on an "as available" and "as is" basis. BIDXUP does not guarantee any particular ranking result, traffic, sales, followers, business result, continuous availability, accuracy of third-party content, or continued availability of any leaderboard.

20. Limitation of Liability

To the maximum extent permitted by applicable law, BIDXUP and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from your use of the Service. Nothing excludes liability where prohibited by Indian law.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless BIDXUP and its owners, operators, employees, contractors, and service providers from claims, losses, liabilities, costs, and expenses arising from your violation of these Terms, unlawful use, submitted content, infringement, or fraudulent or abusive activity.

22. Changes to These Terms

BIDXUP may update these Terms from time to time. If material changes are made, we may provide reasonable notice. Updated Terms become effective from the stated effective date.

23. Governing Law

These Terms shall be governed by the applicable laws of India. Any dispute may be submitted to a competent court in accordance with applicable law.

25. Severability

These Terms, together with the BIDXUP Privacy Policy and other policies expressly referenced on the website, constitute the agreement governing your use of BIDXUP, subject to applicable law.
